The boat swerved to miss one and hit the other, huh? I'm not ready to buy that the driver isn't at fault. You need to be watching what's happening in front of you and stay the hell away from anything/anyone being towed. Also, the throttle on most powerboats is a startlingly effective brake.
I spent many weekend days on Midwestern inland lakes... was on my Sunfish when a drag-boat went over the top of a nearby runabout full of people--some terrible sounds--breaking fiberglass, screams,... Then helicopters...
