I'm wondering if I was asleep or just missed all of the "Legalese" on the side and bottom of each page.
Did that newbie actually saw off most of the keel and rudder to make it fit better on his lawn and garden trailor from Sears that I told him about? Oh, and um - he didn't lose the 75 HP motor mounted on the standard C25 mount did he? I told him it would be too heavy to pull up and down, so to just leave it in the down position.
Seriously, for those concerned, you can get a rider on your insurance to cover any board memberships, etc. wherein you could be construed liable. I've had it...
No, we are just making sure the Association is properly registered with the IRS and protected at least a little from lawsuits. I am being sued at the office. Makes you wonder.

FWIW, I am the author of the initial text 'Notice:'
Several of the officers had discussed the general issue of liability and we were pursuing the safety net similar to most other sailing forums.
The text as it stands at this time is likely to change. However I was exploring the the possible locations of the Notice.
Though I say so myself, I thought it pretty succinct. Some of the caveats that I have read on the net are more like monologues.
Chris suggested modifying the layout of the text to make it less overbearing. This is something that will be decided upon by committee which scares the heck out of me

Personally I'm already at the point where I don't notice the notice.
I'm sure it will be modified over the next few weeks.
hmmmm.... quite amusing actually, but I understand the motivation...
Quite frankly, the ability for someone to suck dry an association is possible. I was on a motorcycle run wherein a big ass GoldWing went down on a gravel road and scuffed his shiny paint job and actually sued the organizers for not warning him that he would be riding on an "unimproved" road...
I still think everyone should shave extra inches off of the keel, remove the backstay, use the cow thing for sheets, AND leave the poptop open in rough conditions.

Sadly, yes... Anytime money changes hands and someone sues for negligence, the odds are good that you will collect just because the costs of dealing with lawyers often exceeds the damages.
My company did some web work et al for a lawyer who has never been to court. She just sends letters and makes phone calls and the insurance companies settle.
I think internet forums are a bit different legally. I've actually never seen a disclaimer on a sailing website, and perhaps never period. I mean really! and this has been said before, "uh your honor, Sten said it was a good idea to store my propane bottles on top of my vented gas tank locker, but he never said it was a bad idea to mount my ashtray just above the cockpit drain - ashtray on a gimbal to facilitate quick dumps, not to keep it level <i>editor</i> - so I accidently had an explosion because Sten was negligent because he did not warn me to keep my ashtray away from the gas tank. I lost my tiller fingers and scorched my balls in the aftermath. I need $ 7 zillion dollars, so I want Sten's C&C 39 - 'cuz it has a wheel, AND his wife, AND whatever money he has left after the economic revolt."
