Steve & Duane - if you think about it - both boats had to be on stbd. and Steve as the windward boat had to keep clear. Not only did the OG (other guy) have to hail "protest" immediately, he also had to "display" a protest flag "immediately", keep it displayed thru'out the race (unless Steve did his penalty turns) and notify the RC at race end that he had a protest against yacht #xxxx. Only then would it be considered a valid protest. (I always seem to be asked to serve on the Protest Committee...) <img src=icon_smile_sad.gif border=0 align=middle> Derek
Whooops! My earlier post seemed to make sense at the time I wrote it, but you guys are right. It's easier to visualize these things when you're on a boat than it is when you're at the keyboard.

I disagree Derek...based only on the original information (and I am contradicted my prior post) Because of their point of sail, unless the course was very, very poorly set, the boats were probably running the line in the starting box. This being the case, Steve could have been the overtaking vessel and could have had rights!!
Sidenote: I still find it rather funny that time after time, protest committees have found and appeals committes have upheld and refound, that the line stating the flag must be flown within a reasonable amount of time means immediately. For example, if you have a man hanging by one fingernail from a stanchion because the contact almost knocked him in the drink, one man with a heart attack and another who sustained a concussion, you better fly the flag before you help out your crew because earliest convenience means now!..
We lost on protest 4 years ago because we said the word foul (not protest) and didn't get the flag up until later in the next leg. Since that time, we have been protested 2 times, winning both of them because the skipper didn't get his flag up in time or used the wrong terminology. Before each protest hearing, we offered the opposing skipper a hundred dollar bottle of wine to drop the protest (neither meant anything in the standings that day, or overall) so we could all go to the crew party. None of them accepted...on the way out of the hearing both skippers, pissed as hell were heard muttering, shoulda taken the G.D. Wine...
