Being a pilot and a boater the rules of the road come to me in differrent forms, I was unable to figure out the stand-on and give-way vessel here......

I can't tell where this is or what vessel is downbound, but its certainly a meeting situation in a narrow channel! And that plane is certainly "restricted in ability to maneuver" {showing the day shapes?)
Tug should be sounding the danger signal and backing down if necessary to avoid collision!

Looking more closely at the pic, I think they are both "parked". There's no smoke from the tug's stack and no disturbed water close to it's stern, indicating no engine running. Derek
